Overview of all obligations
The import and export of goods to the customs territory trigger various obligations. To make it easier to understand the connection between the obligations, they are described below.
Pre-notification of goods (ICS2)
This obligation applies to goods imported from countries outside the EU's customs security area, of which Norway is a part through the EEA Agreement. The obligation means that notification must be given both before loading abroad and before the means of transport arrives in the security area. The purpose of the obligation is, among other things, to ensure that dangerous goods (explosives, etc.) are not loaded on board aircraft or other means of transport before departure to the security area. Furthermore, it is to ensure that goods that may pose a danger to the environment, public health, or consumers are risk-assessed and controlled before being imported into the security area. Pre-notification covers air freight, sea, road, and rail transport.
Declaration obligation; obligation for customs processing and submission of a declaration
For all goods imported into the Norwegian customs territory, there is an obligation for customs processing. Customs processing means that the goods are placed under a customs procedure, re-exported, or surrendered to the customs authorities. This is generally done by submitting a declaration for the chosen procedure. The different procedures determine how the goods can be disposed of. Only the procedure for release for free circulation can grant full right of disposal over a good.
Notification and disclosure obligations upon arrival at the destination in the customs territory
The obligation is twofold in that it regulates both that notification of the means of transport's arrival must be given (the notification obligation) and that information about the means of transport, the crew, and goods brought as cargo must be provided (the disclosure of information obligation). The purpose of the obligation is to provide the customs authorities with information about which means of transport is arriving in the customs territory and which goods the transport is carrying.
Presentation of goods for inspection
An obligation to physically present the goods being carried for inspection. The obligation does not mean that all goods must be physically presented, but the goods must be made physically available for inspection. The presentation obligation is fulfilled when the driver of the means of transport reports to the customs authorities and provides information about the goods they are carrying. This obligation is a cornerstone of the customs authorities' operations and ensures effective control of which goods are imported into the customs territory.
